It is an illusion.

It appears we're attempting to construct a right triangle with sides of length 5 and 13 (thus a hypotenuse of ~13.93). The area of such a triangle would be 32.5. Notice the total area of the pieces used to "construct" the "triangle" are 5+7+8+12=32. (In reality, neither of the constructions is a true triangle, since the slopes of the adjacent hypotenuses are not equal [5/2 != 8/3].) Thus, the apparent "hypotenuse" of the resulting shape is not a straight line. In fact, in so much as it deviates from straightness along the course of its path, it manages to encompass an extra 0.5 unit of area in the upper configuration. Here's a slightly exaggerated picture of what I'm describing:
